Swift Solicitors defeats Access Bank Plc legal team in a labour related contentious matter with Suit No: NICN/LA/201/2013 – Mr Olatunbosun Oluwasogo v. Access Bank Plc.

In a labour related contentious matter, Swift Solicitors successfully defended the interest of an ex-staff of the then Intercontinental Bank Plc who was re-employed by Access Bank Plc in the wake of the merger between Access Bank Plc and Intercontinental Bank Plc.

Access bank however, turned around under some flimsy excuses and later dismissed Mr. Olatunbosun from the employment of the bank.

The case was hard fought, and Access bank legal team fought to sway the Court that the relationship of the bank with Mr. Olatunbosun was simply that of master and servant relationship, and as such the bank could sack Mr. Olatunbosun even for no reason and without explanation.

However, Swift Solicitors legal team successfully argued that the bank had an employment contract with Mr. Olatunbosun which has from the conception regulated their relationship.

It therefore behoves that same contractual agreement must regulate the termination of the relationship which it created ab initio.

In a well-considered Judgment, the National Industrial Court, sitting in Lagos upheld the argument of Swift Solicitors and held that Mr. Olatunbosun’s employment was unlawfully terminated by the bank.

In remedy the Court in her wisdom granted the prayers of Swift Solicitors for the declaration of the purported dismissal of Mr. Olatunbosun as illegal, null and void and of no effect.

The court went further to order the re-instatement of Mr. Olatunbosun and the payment of all his outstanding salaries and allowances till date.
